ORDINANCE NO. 2524

AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER III-BEVERAGES OF THE CITY CODE OF THE CITY OF STERLING , KANSAS 

WITNESSETH : 

WHEREAS, in November of 2019 the voters of the City of Sterling voted to permit the licensing of the sale at retail of alcoholic liquor in the original package in the City of Sterling, Kansas; and 

WHEREAS, the governing body of the City of Sterling, Kansas, on the 1st day of June, 2020, by adoption of Ordinance 2522 approved the sale of alcoholic liquor in the original package in compliance with state law and said ordinance; 

WHEREAS, Ordinance 2522 contained errors and omissions and was repealed by Ordinance 2523; and 

WHEREAS, the governing body of the City of Sterling, Kansas, approved the sale of alcoholic liquor in the original package in the City of Sterling, Kansas, by adoption Ordinance 2523 on the 15th day of June, 2020; and 

WHEREAS, the governing body of the City of Sterling, Kansas desires to establish days and hours of sale of alcoholic liquor in the original package. 

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF STERLING, KANSAS: 

SECTION 1. That a new section, 3-3a04 is added to Chapter III, Article 3a of the Code of the City of Sterling, to wit: 

3-3a04. HOURS OF SALE. No person shall sell at retail any alcoholic liquor: 

(a) On Sunday before 12:00 noon or after 8:00 p.m.; 

(b) On Easter Sunday, Thanksgiving Day or Christmas Day; 

(c) Before 9:00 a.m . or after 11 :00 p.m. on any day when the sale thereof is permitted. 

(K.S.A. 41-7I2) 

SECTION 3. This Ordinance shall be published for two consecutive weeks in the Sterling Bulletin, and shall not become effective until 60 days following the final publication date. If, within 60 days of the last publication, a petition signed by qualified voters of the city equal in number to not less than 5% of the voters of the city who voted for the office of president of the United States at the last preceding general election at which such office was elected, is filed with the county election officer requesting that this proposition be submitted for approval by the voters in accordance with K.S .A. 4 I291 I (b )(2), this ordinance shall not become effective until this proposition is submitted to and approved at an election as provided by K.S .A. 4I-29I l(b).
