Notice of Hearing

The State of Kansas to All Persons Concerned:

You are hereby notified that on the 29th day of March, 2021, a petition has been filed in this Court by Clifford W. Jones, Kerri J. Vagts, and Colleen K. Bisterfeldt, the duly appointed, qualified, and acting Co-Executors of the Estate of Gerald N. Jones, deceased, praying for final settlement of the estate and requesting the Petitioners’ acts be approved; the account be waived; the heirs, devisees, and legatees be determined; the Will be construed and the estate be assigned to the persons entitled thereto; and for the assignment of the below described real estate situated in Rice County, Kansas:

An undivided one-half (1/2) interest in:

The Northeast Quarter (NE/4) of Section Twenty-nine (29), Township Twenty (20) South, Range Seven (7) West of the 6th P.M., Rice County, Kansas.  Dorothy F. Tilton and Harold A. Tilton, wife and husband, reserved to themselves an undivided one-half (1/2) interest in and to all of the oil, gas or other minerals in and under and that which may be produced from the Northeast Quarter (NE/4) of Section Twenty-nine (29), Township Twenty (20) South, Range Seven (7) West of the 6th P.M., Rice County, for a period of Twenty (20) years from the date of the deed conveying ownership to Gerald N. Jones, which was December 30, 1988 and recorded in Rice County in Book 151 at Page 881, and so long thereafter as oil, gas or other minerals is being produced on the Northeast Quarter (NE/4) of Section Twenty-nine (29), Township Twenty (20) South, Range Seven (7) West of the 6th P.M., Rice County, Kansas, or the North Half of the Southwest Quarter (N/2 SW/4) of Section Four (4) Township Twenty-one (21) South, Range Seven (7) West of the 6th P.M., Rice County, Kansas;

and other assets of said estate by decree of said Court to these entitled thereto, the Court find the costs be determined and ordered paid; the administration of the Estate be closed; upon the filing of receipts the Petitioners be finally discharged as Executors of the Estate of Gerald N. Jones, deceased, and the Petitioners be released from further liability.

You are required to file your written defenses to the petition on or before the 27th day of April, 2021; at 10:00 a.m. in the Rice County District Court, located at 101 W. Commercial St., Lyons, Kansas 67554, at which time and place the cause will be heard.  Should you fail to file your written defenses, judgment and decree will be entered in due course upon the petition.
