ORDINANCE NO. 2587

AN ORDINANCE FOR ENVIRONMENTAL REMEDIATION RIDER ADDER TO RATES FOR ELECTRICITY OF THE CITY OF STERLING, KANSAS.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF STERLING, KANSAS, to-wit:

SECTION 1. The City shall apply an Environmental Remediation Rider (ERR) for costs directly related to upgrades, repairs, filings, penalties and modifications incurred by the City because of State or Federal Regulatory Agencies imposing changes on power generation or delivery for environmental reasons. This will be passed on to consumers on a per kWh basis to all customers and all kWh’s consumed, including those netted by customer-owned generation.  

SECTION 2. The ERR shall be calculated as follows and billed as a separate line item on customer bills: 

ERR = Annual cost &/or pmt. for environmental remediation in

most recent calendar year

Total kWh Sold in most recent calendar year

The ERR rate calculated above shall be applied to all sales in the following calendar year. The rate shall be rounded to the nearest $0.001 (3 decimal places of accuracy) and recalculated annually.

SECTION 3. That this ordinance shall take effect and be in force from and after its passage, approval and publication in the official City newspaper.
