THE STATE OF KANSAS TO ALL PERSONS CONCERNED:

You are hereby notified that a petition has been filed on 17th day of June 2026, in this court by Suzanne Kay Mathes, an heir in the Estate of James Albert Mathes, deceased praying for the determination of descent in the following described real property, to-wit:

The Northeast Quarter (NE/4) of Section 27, Township 21 South, Range 8 West of the 6th Principal Meridian, Rice County, Kansas, EXCEPT Railroad Right-of-Ways, and EXCEPT a tract of land commencing at a point or the Southerly line of the Missouri Pacific Railway Right-of-way, where the Southerly line of the said Right-of-way intersects the West line of the Northeast Quarter (NE/4) of said Section 27; and running thence Eastwardly, along said Right-of-way, 1200 feet; thence Southwardly, and perpendicular to said Right-of-way, 480 feet; thence Westwardly, parallel to the South line of said Northeast Quarter (NE4) of said Section 27, and perpendicular to the West line of said Northeast Quarter (NE/4)of Section 27, to the West line of said Quarter Section; thence North, along said West line of said Quarter Section, to the place of beginning, and also EXCEPT a certain triangular tract of land located in and on the Northeast Quarter (NE/4) of Section 27, Township 21 South, Range 8 West of the 6th Principal Meridian, and being more particularly described as commencing at a point on the Southerly line of the Missouri Pacifica Railway Right-of-Way, 1200 feet Southeasterly from where said Southerly line intersects the West line of said Northeast Quarter (NE/4) of said Section 27; thence 480 feet Southwestwardly, and perpendicular to said Right-of-Way, as a point of beginning; and running thence West, parallel to the South line of said Northeast Quarter (NE/4) of Section 27, to the West line of said Northeast Quarter (NE/4) of Section 27; thence South to the Southwest Corner of the North Half (N/2) of the Southwest Quarter (SW/4) of the Northeast Quarter (NE/4) of said Section 27; thence Northeasterly to the place of beginning.

and all other property in Kansas, real and personal, or interests therein, owned by the decedent at the time of his death.  You are hereby required to file your written defenses to such petition on or before the 17th day of July, 2026 at 10:00 o’clock a.m. on said day, in said court, in the city of Lyons, Rice County, Kansas, at which time and place said cause will be heard.  Should you fail therein, judgment and decree will be entered in due course upon such petition.

A tract of land in the City of Lyons, Rice County, Kansas, more particularly described as commencing 592 feet West of the Southeast Corner of the Northwest Quarter (NW/4) of Section 3, Township 20 South, Range 8 West of the 6th PM., Rice County, Kansas, and running thence West 184 feet; thence North 150 feet; thence East 184 feet; thence South 150 feet to the place of beginning.
